Terms of Service

Agreement

By using 3rdstreetdesigns.com or purchasing services from 3rd Street Designs, Inc., you agree to these Terms of Service.

Services

We provide software deployment, digital infrastructure configuration, and automation setup services, including Google Business Profile structure optimization, AI-assisted review response dashboards, performance reporting, and citation network management. Software Provisioning & Operational Control Model: We architect, configure, and deploy your automation systems; you retain full administrative ownership, execution authority, and final approval over all accounts and communications.

Dominance Tier: Includes up to 2 hours per month of manual reputation consulting and competitor tracking. Hours are non-transferable and do not roll over. Additional hours beyond the monthly allotment are billed at standard consulting rates as specified in the applicable Service Agreement.

Payment Terms

• Monthly Fees: As specified in your signed Service Agreement or current published rate schedule — billed monthly, non-refundable

Cancellation

• Notice Required: 60 days written notice to legal@3rdstreetdesigns.com
• Cancel before work begins: Client retains no materials
• Cancel between 1 day and 1 year of service: Materials and refund terms negotiated on a case-by-case basis
• Cancel after 1+ year of service: Client retains all deliverables

Client Responsibilities

• Provide accurate business information
• Maintain Google Business Profile login credentials
• Review, approve, and authorize all automated workflows and response drafts within the dashboard
• Comply with FTC guidelines and Google policies

No Guarantees

We do not guarantee:

• Specific number of reviews
• Star rating improvements
• Removal of negative reviews (we flag policy violations; Google decides)
• Increased revenue or job volume

Liability Limitations

Our liability is limited to fees paid in the 3 months prior to claim. We are not liable for:

• Defamation claims from review responses (client controls all postings)
• Google account suspensions due to client policy violations
• Lost revenue or business opportunities

FTC & Google Compliance

Client agrees to follow FTC endorsement guidelines and Google Business Profile policies. We do not solicit incentivized reviews or manipulate ratings.

Dispute Resolution

Disputes resolved via binding arbitration in Wake County, NC under North Carolina law.

Changes to Terms

We may update these Terms. Continued use after changes constitutes acceptance.
